Welcome to Kamene.
These Terms of Use govern your access to and use of the mobile application "Kamene" (referred to as "the App") designed to connect artists and art enthusiasts in Africa, allowing them to discover art places and events. By accessing or using the App, you agree to be bound by these Terms of Use. If you do not agree with these terms, please do not use the App.
1.1. Eligibility: You must be at least 13 years old to use the App. If you are under 13, you may not create an account or use the App without parental consent.
1.2. Account Creation: To access certain features of the App, you may need to create a user account. The information you provide during registration must be accurate, complete, and up-to-date. You are responsible for safeguarding your account credentials and must not share them with anyone else. You are liable for all activities that occur under your account.
1.3. User Conduct: You agree to use Kamene for lawful purposes and in compliance with these Terms of Use. When using the App, you agree not to:
Violate any applicable laws, regulations, or third-party rights.
Post, share, or transmit any content that is unlawful, harmful, defamatory, obscene, or otherwise objectionable.
Engage in any conduct that may interfere with or disrupt the functioning of the App or the servers and networks connected to it.
Attempt to gain unauthorized access to the App, user accounts, or computer systems.
1.4. Content Ownership: As a user of Kamene, you retain ownership of the content you post, share, or submit through the App. However, you grant Kamene a non-exclusive, royalty-free, worldwide license to use, display, and distribute your content solely for the purposes of operating and improving the App.
2.1. App Ownership: Kamene and its content (including but not limited to text, graphics, logos, and software) are owned by Kamene or its licensors and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App or its content without explicit permission.
2.2. User Content: By posting or sharing content through the App, you represent that you have the necessary rights to do so, and that such content does not infringe on any third-party intellectual property rights.
Your use of the App is subject to our Privacy Policy, which outlines how we collect, use, and disclose your information. By using Kamene, you consent to the practices described in the Privacy Policy.
The App may contain links to third-party websites, services, or resources that are not owned or controlled by Kamene. We are not responsible for the content or practices of these third-party platforms. Your interactions with such third-party services are solely between you and the respective third party.
5.1. Modifications to the App: We reserve the right to modify, suspend, or discontinue the App (or any part thereof) at any time without prior notice. We are not liable to you or any third party for any such modifications, suspension, or discontinuation.
5.2. Termination: We may terminate your access to the App at any time for any reason or no reason, without prior notice. Upon termination, your right to use the App will immediately cease.
The App is provided on an "as-is" and "as available" basis, without any warranties of any kind, whether express or implied. Kamene disclaims all warranties, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.
To the maximum extent permitted by law, Kamene and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App or any content posted therein.
You agree to indemnify and hold harmless Kamene and its affiliates from and against any and all claims, liabilities, damages, losses, or expenses arising out of your use of the App, your content, or any violation of these Terms of Use.
These Terms of Use are governed by the laws of Kenya. Any dispute arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of Kenya.
